1. Agreement
The website mytour.tours and any related mytour website, application, booking interface, customer account, or digital service are operated by บริษัท มาย ทัวร์ จำกัด, referred to in English in these Terms as “My Tour Co., Ltd.”
บริษัท มาย ทัวร์ จำกัด is a private limited company registered in Thailand under Registration No. 0835569011377, with its registered address at:
130/122 Moo 5, Ratsada Subdistrict, Mueang Phuket District, Phuket 83000, Thailand.
The website and related digital services are collectively referred to in these Terms and Conditions as the “Platform” or “mytour.”
These Terms and Conditions govern your access to the Platform and your purchase or use of tours, activities, attraction tickets, transportation, transfers, experiences, and other travel-related services offered through it, collectively referred to as the “Services.”
The terms “you,” “your,” “customer,” and “traveller” refer to any person who accesses the Platform, creates an account, makes a booking, participates in a Service, or makes a booking on behalf of another person.
By accessing the Platform, creating an account, submitting a booking, or using any Service, you confirm that you have read, understood, and agreed to these Terms and Conditions.
If you make a booking on behalf of other participants, you confirm that you are authorized to accept these Terms on their behalf and that you will provide them with all relevant booking information, restrictions, and safety requirements.
If you do not agree to these Terms, you must not use the Platform or make a booking through it.
2. mytour’s Role
mytour provides booking, arrangement, customer-support, and related travel services.
The underlying tours, activities, transportation, attraction admissions, experiences, and other travel services may be performed by independent third-party tour operators, transportation providers, attraction operators, boat operators, guides, venues, and other service providers, collectively referred to as “Service Providers.”
Where a Service is performed by an independent Service Provider, that Service Provider is responsible for the operational delivery of the Service, including its vehicles, boats, equipment, guides, staff, safety procedures, licences, schedules, routes, and compliance with laws applicable to its operations.
Where My Tour Co., Ltd. itself is expressly identified as the provider of a particular Service, it will be responsible for that Service in accordance with the applicable booking conditions and law.
My Tour Co., Ltd. remains responsible for obligations that it cannot lawfully exclude, including obligations arising directly from its own acts, omissions, booking administration, payment handling, representations, or customer service.
Nothing in these Terms excludes or restricts any right or remedy that cannot legally be excluded under applicable law.
3. Service-Specific Conditions
Each Service may be subject to additional conditions shown on its product page, booking page, ticket, voucher, confirmation message, or checkout screen.
These conditions may include:
· Cancellation deadlines;
· Refund eligibility;
· Pickup times and locations;
· Age, height, weight, health, or fitness requirements;
· Nationality or residency restrictions;
· Participant limits;
· Luggage limits;
· Clothing requirements;
· Prohibited items;
· Accessibility limitations;
· Weather conditions;
· Identification requirements;
· Security deposits;
· Operating days;
· Minimum participant requirements; and
· Other rules imposed by the relevant Service Provider or competent authority.
The conditions displayed for the specific Service form part of your booking agreement.
Where a Service-specific condition conflicts with a general provision in these Terms, the Service-specific condition will apply to that booking, except where applicable law requires otherwise.
4. Changes to These Terms
mytour may update these Terms from time to time to reflect changes in its Services, operations, technology, policies, or legal obligations.
The version applicable to a booking is normally the version published and accepted when the booking was made.
Changes published after a confirmed booking will not materially reduce the customer’s contractual rights for that booking unless the change is required by law, required for safety, or expressly accepted by the customer.
Continued use of the Platform after updated Terms are published constitutes acceptance of those updated Terms for future use and future bookings.
5. Access to the Platform
mytour does not guarantee that the Platform will always be available, uninterrupted, error-free, or compatible with every device, browser, network, or payment method.
mytour may temporarily restrict, suspend, update, or discontinue all or part of the Platform for maintenance, security, technical, operational, or legal reasons.
mytour may also change, add, suspend, or remove Services offered through the Platform.
A Service appearing on the Platform does not guarantee that it will remain available for any particular date, time, destination, or number of participants.
6. Images, Videos, Maps, and Descriptions
Images, videos, maps, illustrations, schedules, vehicle images, boat images, route information, and descriptions displayed on the Platform are intended to help customers understand the general nature of a Service.
Actual details may vary due to weather, sea conditions, traffic, season, safety requirements, operational needs, maintenance, availability, or decisions made by the Service Provider or competent authorities.
Vehicles, boats, equipment, meals, guides, locations, routes, schedules, and activity sequences may differ from those displayed, provided that the essential nature and value of the booked Service are not materially reduced.
Images of a particular vehicle, boat, room, seat, or item do not guarantee that the identical model, colour, configuration, or appearance will be provided unless the booking expressly states otherwise.
7. Intellectual Property
The Platform and its content, including its text, designs, layouts, databases, software, graphics, logos, visual identity, photographs, videos, icons, trademarks, domain names, and the mytour name, are owned by, licensed to, or otherwise lawfully used by mytour and/or the applicable rights holder.
You may use the Platform only for personal and lawful booking purposes.
You must not, without prior written permission:
· Copy or reproduce substantial parts of the Platform;
· Republish or commercially exploit Platform content;
· Modify or create derivative works from Platform content;
· Extract or reuse databases or substantial collections of information;
· Use mytour’s trademarks, branding, or visual identity;
· Frame, mirror, or imitate the Platform;
· Remove copyright, trademark, or ownership notices; or
· Use Platform content to establish or promote a competing service.
8. Eligibility and Customer Accounts
You must be at least 18 years old and legally capable of entering into a binding agreement to make a booking.
A person under 18 may use or participate in a Service only where permitted by the relevant Service Provider and under the responsibility or supervision of a parent or legal guardian.
An account may be created during checkout or through another registration process.
You are responsible for:
· Providing accurate and complete information;
· Keeping your login credentials confidential;
· Preventing unauthorized access to your account;
· Reviewing bookings made through your account; and
· Informing mytour promptly if you believe your account has been compromised.
You must not create accounts using false identities, impersonate another person, or create multiple accounts to misuse discounts, credits, referral benefits, or promotions.
mytour may suspend, restrict, or close an account where it reasonably suspects fraud, unauthorized use, security risks, misuse, illegal activity, or a material violation of these Terms.
9. Bookings Made by Authorized Partners
mytour may permit authorized travel agencies, agents, resellers, freelancers, or other partners to make bookings on behalf of their customers.
Where a booking is made on behalf of another person, the person or partner making the booking is responsible for providing accurate booking information and for ensuring that the participating customer receives the applicable Service details, conditions, restrictions, and cancellation terms.
The applicable booking conditions and relevant provisions of these Terms continue to apply to the booking and the participating customer.
Any separate commercial arrangement between mytour and an authorized partner is governed independently and does not form part of these public Terms and Conditions.
10. Reviews and Customer Content
Customers may be permitted to submit reviews, ratings, photographs, videos, comments, questions, or other content.
You remain responsible for content you submit and confirm that:
· It is based on your genuine experience where presented as a review;
· It is accurate to the best of your knowledge;
· It does not violate another person’s rights;
· It does not contain unlawful, threatening, discriminatory, defamatory, misleading, obscene, or fraudulent material;
· It does not disclose another person’s private information without authorization; and
· You have the right to submit and permit the use of the content.
By submitting content, you grant mytour a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, translate, adapt, publish, display, distribute, and use that content for operating, improving, and promoting mytour and its Services.
This licence continues for as long as reasonably necessary for those purposes, subject to applicable law and any valid withdrawal or deletion rights.
mytour may moderate, reject, hide, or remove content that violates these Terms, appears fraudulent, is irrelevant, creates legal or security risks, or is otherwise inappropriate for the Platform.
mytour is not required to publish every submitted review.
11. Booking Requests and Confirmation
Submitting payment or a booking request does not always mean that the Service has been confirmed.
Some Services are confirmed immediately. Others require confirmation from the relevant Service Provider.
A booking becomes confirmed when mytour issues a booking confirmation, ticket, voucher, or other clear confirmation that the booking has been accepted.
If a requested Service cannot be confirmed, mytour may:
· Offer an alternative date, time, option, or Service;
· Request additional information;
· Place the booking on hold while availability is checked; or
· Cancel the booking and refund the amount collected for the unavailable Service.
You must review the booking confirmation immediately and notify mytour promptly of any error.
Tickets and vouchers may be delivered through the customer account, website, email, WhatsApp, SMS, or another contact channel provided during booking.
You agree to receive operational booking communications through the contact information you provide.
12. Booking Information and Special Requests
You are responsible for providing accurate and complete booking information, including where applicable:
· Full names;
· Nationalities;
· Dates of birth;
· Identification or passport details;
· Telephone numbers;
· Email addresses;
· Hotel or accommodation details;
· Pickup and drop-off locations;
· Flight numbers and arrival times;
· Participant numbers;
· Child ages;
· Health or mobility information;
· Luggage quantities and sizes;
· Selected dates and options; and
· Any other information reasonably required to provide the Service.
mytour and the Service Provider are not responsible for disruption, delay, missed service, refusal of participation, or additional cost caused by incorrect, incomplete, outdated, or late information supplied by the customer.
Additional costs resulting from customer-provided errors may be charged to the customer where reasonably incurred and disclosed.
Special requests, preferences, or requirements are subject to availability and are not guaranteed unless expressly confirmed as part of the booking.
Customers with food allergies, dietary restrictions, or other special meal requirements must notify mytour before the Service. The availability of suitable alternatives is subject to the Service Provider and is not guaranteed unless expressly confirmed.
13. Prices and Currency
The price payable for a booking will be shown during checkout before payment is submitted.
Prices may be displayed in Thai Baht or another available currency.
The currency applicable to the transaction will be displayed during checkout. Your bank, card issuer, digital-wallet provider, or payment processor may apply its own foreign-exchange rate, cross-border fee, card fee, or other charge.
mytour does not control and is not responsible for fees or exchange rates imposed independently by your bank, card issuer, payment provider, or financial institution.
Currency conversions shown on the Platform may be estimates and may differ from the final amount charged by your payment provider.
Prices may change at any time before a booking is confirmed. A later price change does not normally affect an already confirmed booking unless the original price resulted from an obvious error.
14. Taxes and Additional Charges
Displayed prices will include taxes and mandatory charges where stated or required.
Certain fees may be payable separately where clearly disclosed, including:
· National park fees;
· Pier fees;
· Transfer-zone surcharges;
· Extra luggage charges;
· Overtime charges;
· Optional activities;
· Optional equipment;
· Security deposits;
· Food or drink not included in the booking;
· Child or infant charges;
· Entrance fees; or
· Charges resulting from customer-requested changes.
Customers are responsible for reviewing what is included and excluded before booking.
15. Payment Authorization
By submitting payment details, you confirm that:
· You are authorized to use the selected payment method;
· The payment information is accurate;
· The transaction is not fraudulent or unlawful; and
· You authorize the applicable amount to be charged.
Payments may be processed by third-party banks, payment gateways, card networks, digital-wallet providers, or other financial-service providers.
mytour does not store complete payment-card details where payment processing is handled by an external payment provider.
A booking may be cancelled or remain unconfirmed if payment fails, is reversed, is rejected, is not received, or cannot be verified.
16. Coupons, Promotional Codes, Credits, and Discounts
mytour may offer coupons, promotional codes, vouchers, credits, referral benefits, or discounts.
Each promotion may be subject to separate conditions, including:
· Expiry dates;
· Eligible Services;
· Minimum booking values;
· Customer eligibility;
· Geographic restrictions;
· Maximum discounts;
· Limited availability;
· Usage limits; and
· Excluded dates or products.
Unless expressly stated otherwise:
· A promotion may be used only once;
· Promotions cannot be combined;
· Promotions have no cash value;
· Promotions cannot be exchanged for cash;
· Promotions cannot be transferred, sold, or resold; and
· Any unused promotional value will not be refunded in cash.
Where a booking made using a promotion is cancelled, the promotional value may expire or be returned as promotional credit rather than cash, depending on the promotion’s conditions and the reason for cancellation.
mytour may reject, cancel, or withdraw a promotion where it reasonably suspects fraud, manipulation, duplicate accounts, unauthorized resale, automated use, or violation of promotional conditions.
Changes to a promotion will not remove rights already acquired under a confirmed booking, except where fraud, error, or unlawful use is involved.
17. Fraud Prevention and Payment Verification
mytour may use reasonable fraud-prevention and identity-verification measures.
A booking may be delayed, suspended, or cancelled where mytour or its payment provider reasonably suspects:
· Unauthorized card use;
· Identity theft;
· Payment fraud;
· Promotion abuse;
· False information;
· Account compromise;
· Unlawful activity; or
· A material security risk.
mytour may request identification, proof of authorization, payment verification, or additional booking information.
Where fraud is confirmed, mytour may cancel bookings, suspend accounts, retain relevant evidence, cooperate with payment providers or authorities, and seek recovery of losses where permitted by law.
18. Chargebacks and Payment Disputes
Customers should contact mytour first where they believe a payment or booking is incorrect so that the matter can be investigated.
A customer must not knowingly submit a false, misleading, or abusive chargeback or payment dispute.
If a chargeback or payment dispute is submitted, mytour may provide relevant booking, transaction, communication, and service records to the payment provider or financial institution as necessary to respond to the dispute.
Nothing in this section prevents a customer from exercising a legitimate right to dispute an unauthorized or improperly processed transaction.
19. Cancellation by the Customer
Cancellation conditions depend on the specific Service and are displayed on the relevant product page, booking page, checkout page, voucher, or confirmation.
To request cancellation, the customer must contact mytour through an available official support channel and provide the booking reference and relevant details.
A cancellation is effective only when received and acknowledged by mytour or processed through an approved self-service cancellation function.
Unless the specific booking conditions state otherwise:
· Cancellations made within the permitted cancellation period may qualify for a full or partial refund;
· Cancellations made after the permitted deadline may be non-refundable;
· No-shows are non-refundable;
· Unused portions of a Service are non-refundable; and
· Voluntary early departure from a Service does not create a right to a refund.
Any mandatory legal rights remain unaffected.
20. Refunds
Approved refunds will normally be returned to the original payment method unless another method is agreed or technically required.
The time required for a refund to appear depends on the payment method, payment processor, card network, bank, and country.
mytour is not responsible for processing time controlled solely by an external bank or payment provider, but it remains responsible for submitting an approved refund within a reasonable period.
Unless required by law or expressly agreed otherwise:
· A refund will not exceed the amount actually paid for the affected booking;
· Currency-exchange differences imposed by a bank or card issuer are not refundable by mytour;
· External bank or card fees may not be refundable;
· Promotional value may be returned as promotional credit rather than cash; and
· Refunds may be reduced by any clearly disclosed and lawfully applicable cancellation charge.
Where only part of a Service is materially affected, any refund may be proportionate to the affected portion.
21. Requests and Complaint Notification
Customers should notify mytour of a booking problem as soon as reasonably possible so that mytour or the Service Provider has an opportunity to investigate and provide assistance.
Where a problem occurs during a Service, the customer should raise it immediately with the guide, driver, venue, Service Provider, or mytour support where reasonably possible.
Customers are requested to submit post-Service complaints within three calendar days after the scheduled Service date, together with the booking reference, an explanation of the issue, and any relevant evidence.
A delay in reporting may affect mytour’s ability to investigate and verify the circumstances.
The three-day notification period does not eliminate any statutory right or legal claim that cannot lawfully be waived.
22. Pricing and Information Errors
The Platform may occasionally contain technical, typographical, programming, currency-conversion, availability, or pricing errors.
Where an obvious or material error occurs, mytour may correct the information and:
· Ask the customer to confirm the booking at the correct price or under the correct conditions; or
· Cancel the affected booking and refund the amount paid.
mytour will not knowingly rely on a minor error to cancel a valid booking after the Service has been fully confirmed and performed.
Cancellation caused by a genuine and obvious error does not entitle the customer to additional compensation except where required by applicable law.
23. Customer-Requested Changes
Requests to change a date, participant name, pickup point, option, vehicle, route, ticket, or other booking detail are subject to availability and the conditions of the Service.
A requested change is not confirmed until mytour issues written confirmation.
A change may result in:
· A price difference;
· An amendment fee;
· Loss of a discount;
· New cancellation conditions; or
· Cancellation and rebooking.
Some tickets, attractions, promotions, and date-specific Services cannot be amended after confirmation.
24. Operational Changes and Rescheduling
mytour or the Service Provider may make reasonable operational changes due to:
· Weather or sea conditions;
· Traffic;
· Safety concerns;
· Government or regulatory instructions;
· National park restrictions;
· Attraction closures;
· Vehicle or boat availability;
· Maintenance;
· Insufficient participant numbers;
· Delays affecting other participants; or
· Other operational circumstances.
Changes may include adjusting the pickup time, departure time, route, itinerary order, activity sequence, transport type, meeting point, or duration.
Where the essential nature of the Service remains substantially the same, reasonable operational changes do not automatically entitle the customer to a refund.
Where a change materially reduces or replaces the essential Service, mytour may offer an appropriate alternative, rescheduling option, partial refund, or cancellation and refund, depending on the circumstances and applicable law.
25. Cancellation by mytour or a Service Provider
A Service may be cancelled before or during operation due to:
· Unsafe weather or sea conditions;
· Natural events;
· Government orders;
· National park closures;
· Attraction closures;
· Operational failure;
· Vehicle or vessel breakdown;
· Safety concerns;
· Insufficient participant numbers;
· Regulatory restrictions; or
· Other circumstances that make performance impossible, unlawful, or unsafe.
Where a Service is cancelled before it begins, the customer will normally be offered one or more of the following:
· Rescheduling;
· An equivalent alternative;
· Booking credit; or
· A refund of the amount paid for the cancelled Service.
The appropriate remedy will depend on the reason for cancellation, the Service already received, the specific booking conditions, and applicable law.
A customer is not required to accept a materially different replacement Service.
26. Weather and Sea Conditions
Weather forecasts and sea conditions may change quickly.
The final decision on whether a marine, outdoor, or adventure activity can operate safely may be made by the Service Provider, boat captain, guide, venue, national park authority, harbour authority, or other competent authority.
Rain, cloud cover, reduced visibility, waves, or changes in the itinerary do not automatically require cancellation or a refund where the Service can still operate safely and substantially as described.
Customers who independently decide not to attend while the Service continues to operate will be treated according to the customer-cancellation and no-show conditions.
27. National Parks, Islands, Beaches, and Attractions
Access to national parks, islands, beaches, bays, viewpoints, attractions, and protected areas may be limited or prohibited due to seasonal closure, environmental protection, capacity restrictions, tides, weather, safety, or official orders.
mytour and the Service Provider cannot guarantee access to every advertised stop where access is controlled by authorities or safety conditions.
Where one stop becomes unavailable, the Service Provider may adjust the itinerary or substitute a reasonably comparable stop.
Entrance fees or national park fees are included only where expressly stated.
Customers may be required to show identification, proof of nationality, or other documents where authorities apply different admission conditions.
28. Pickup and Shared Transportation
Pickup times may be stated as an approximate time or a time range.
Shared transportation may involve multiple hotel pickups and drop-offs. The vehicle may therefore arrive earlier or later than the estimated time due to traffic, route conditions, other passengers, hotel access, or operational sequencing.
Customers must:
· Be ready at the confirmed location before the pickup time;
· Keep their telephone available;
· Provide an accurate hotel name and address;
· Inform mytour of hotel changes promptly; and
· Follow pickup instructions in the confirmation.
A pickup delay does not necessarily mean that the Service has been cancelled.
Customers should contact mytour before leaving the pickup location.
29. Airport Transfers and Flight Information
For airport transfers, customers must provide accurate flight, terminal, date, arrival, departure, and contact information.
Customers are responsible for checking the booked airport, pickup date, and flight timing, particularly for flights departing after midnight.
Waiting time, meeting-point instructions, and flight-delay treatment may vary by Service and will be stated in the booking details where applicable.
Additional waiting charges may apply if:
· The customer provides incorrect flight information;
· The customer changes flights without notifying mytour;
· The customer is delayed for reasons unrelated to normal immigration, baggage, or airport procedures;
· The customer cannot be contacted; or
· The included waiting period is exceeded.
If a flight is cancelled, diverted, or substantially delayed, the customer must notify mytour as soon as possible. Rescheduling remains subject to vehicle availability and the applicable booking conditions.
30. Luggage and Passenger Capacity
Customers must book a vehicle suitable for the number of passengers and the amount and size of luggage.
Vehicle capacity descriptions are estimates based on standard passenger and luggage sizes.
Oversized suitcases, sports equipment, wheelchairs, strollers, golf bags, surfboards, bicycles, or other large items must be disclosed before confirmation.
A large or oversized item may count as more than one standard piece of luggage.
The driver or Service Provider may refuse unsafe overloading.
Where the booked vehicle cannot safely accommodate the declared passengers or luggage, the customer may be required to arrange and pay for an additional or larger vehicle.
31. Punctuality and No-Shows
Customers must arrive at the meeting point or be ready at the pickup location at the stated time.
Customers must allow sufficient time for traffic, transport connections, airport procedures, parking, walking, and locating the meeting point.
Where a customer is late and misses the Service, the booking may be treated as a no-show and may be non-refundable.
A Service Provider is not required to delay a shared tour, boat, vehicle, attraction entry, or group activity for a late customer.
Where possible, mytour may assist with alternative arrangements, but any additional cost may be payable by the customer.
32. Tickets and Admission
Customers are responsible for checking whether a ticket:
· Requires advance reservation;
· Is valid only on a specific date or time;
· Requires identification;
· Must be printed;
· Must be exchanged at a counter;
· Requires the cardholder to attend;
· Has nationality or residency conditions;
· Allows re-entry; or
· Is transferable.
Lost, deleted, forgotten, or unused tickets may not be replaceable or refundable.
Admission remains subject to the venue’s rules, opening hours, dress code, safety requirements, and right to refuse entry for lawful reasons.
33. Age, Height, Weight, Health, and Fitness Requirements
Certain Services may impose age, height, weight, pregnancy, mobility, health, or physical-fitness restrictions.
Customers are responsible for reviewing these restrictions before booking and for providing accurate participant information.
Customers should seek professional medical advice before participating where they have concerns regarding pregnancy, heart conditions, recent surgery, back or neck problems, mobility limitations, serious medical conditions, or physical fitness.
mytour and the Service Provider may refuse participation where a customer does not meet a stated requirement or where participation would create a reasonable safety risk.
Where the restriction was clearly disclosed before booking, refusal on this basis may not qualify for a refund.
34. Children, Infants, and Supervision
Children must be supervised by a responsible adult at all times unless the Service expressly provides supervised childcare or a dedicated children’s programme.
Parents and guardians are responsible for determining whether a Service is appropriate for a child.
Child pricing and eligibility may depend on age, height, nationality, or the Service Provider’s rules.
Proof of age may be required.
If a child does not meet the applicable requirements, the Service Provider may charge the correct price or refuse participation.
Some Services may allow infants to participate free of charge, while other Services may charge for infants or may not permit infants to participate.
Where an infant is permitted to participate free of charge, this does not automatically include a separate seat, child or infant car seat, infant-sized safety equipment, meals, or other dedicated infant facilities unless specifically stated in the Service details.
Parents and guardians are responsible for reviewing the applicable age requirements and Service information before booking and for confirming that the Service and any available facilities are suitable for the infant.
35. Conduct and Safety Instructions
Customers must behave responsibly and follow all reasonable safety, legal, and operational instructions issued by mytour, the Service Provider, guides, drivers, captains, venue staff, or competent authorities.
A customer may be refused participation or removed from a Service where the customer:
· Endangers themselves or others;
· Is violent, threatening, abusive, or disruptive;
· Is seriously intoxicated;
· Possesses prohibited or unlawful items;
· Damages property;
· Refuses safety instructions;
· Harasses staff or other participants; or
· Engages in unlawful conduct.
Where removal or refusal results from the customer’s misconduct, no refund or compensation will normally be provided, and the customer may be responsible for resulting damage or reasonable additional costs.
Customers must comply with applicable laws, regulations, and rules relating to national parks, protected areas, marine environments, wildlife, and other locations visited as part of a Service.
If a customer’s conduct results in a fine, penalty, charge, confiscation, or other consequence imposed by an authority or Service Provider because the customer violated an applicable rule or law, that customer will be responsible for the resulting amount or consequence.
36. Alcohol, Drugs, and Intoxication
Customers must not participate in a Service while impaired to an extent that creates a safety risk.
Illegal drugs and unlawful substances are prohibited.
The Service Provider may refuse participation where it reasonably believes that a customer’s condition makes participation unsafe or unlawful.
Refusal on this basis may be treated as a no-show and may be non-refundable.
37. Acknowledgment of Activity Risks
Certain marine, outdoor, transportation, recreational, wildlife, and adventure Services involve inherent risks that cannot be completely eliminated.
These may include risks associated with:
· Boats and water;
· Swimming and snorkelling;
· Waves, tides, and currents;
· Slippery or uneven surfaces;
· Heights;
· Speed;
· Animals;
· Weather;
· Road traffic;
· Remote locations;
· Physical exertion; and
· Equipment use.
Customers are responsible for considering whether they and the participants included in their booking are suitable for the Service.
Customers must use provided safety equipment and comply with instructions.
This acknowledgment does not exclude liability that cannot legally be excluded, including liability arising from legally actionable negligence or misconduct.
38. Wildlife and Animal Activities
Where a Service involves animals or wildlife, animal behaviour may be unpredictable.
Customers must follow all instructions and must not touch, feed, approach, provoke, or interact with animals except where expressly permitted and supervised.
Wildlife sightings and animal behaviour cannot be guaranteed.
39. Personal Belongings
Customers are responsible for safeguarding their money, passports, telephones, jewellery, luggage, cameras, documents, and other personal belongings.
Customers should not leave valuables unattended in vehicles, boats, venues, waiting areas, or shared storage spaces.
mytour and Service Providers are not responsible for loss, theft, or damage unless caused by a breach of a legal duty for which liability cannot be excluded.
Any lost-property report should be made promptly. Recovery and return cannot be guaranteed, and delivery costs may be payable by the customer.
40. Damage Caused by Customers
Customers may be responsible for damage they or participants in their booking intentionally or negligently cause to vehicles, boats, rooms, equipment, venues, property, or another person’s belongings.
mytour or the Service Provider may request reasonable payment for verified repair, cleaning, replacement, recovery, or other direct costs.
41. Photographs and Videos During Services
Photographs or videos may be taken during a Service by Service Providers, guides, photographers, venue staff, other participants, or third parties.
By participating in the Service, customers acknowledge that they may appear in photographs or videos that may be published, edited, shared, distributed, or displayed through websites, social media, advertising, promotional materials, news or media channels, and other public or digital platforms, without financial compensation.
mytour is not responsible for the independent publication, distribution, editing, sharing, or other use of such photographs or videos by Service Providers, other customers, media organizations, members of the public, or other third parties.
42. Customer Photography and Recording
Customers may take photographs and videos only where permitted by the Service Provider, venue, property owner, and applicable law.
Customers must respect the privacy and dignity of other participants, staff, local communities, and children.
Commercial filming, professional production, drones, tripods, lighting equipment, or restricted-area recording may require advance permission.
Customers are responsible for complying with drone, aviation, privacy, national park, and venue rules.
43. Passports, Visas, Immigration, and Travel Documents
Customers are responsible for ensuring that they hold valid passports, visas, permits, entry permissions, insurance, vaccination documents, and other travel documents required for their journey or participation.
mytour does not provide immigration or legal advice unless expressly stated.
A customer’s inability to use a booked Service because of missing, invalid, expired, or insufficient travel documentation does not normally create a right to a refund.
44. Insurance
Customers are responsible for obtaining appropriate personal travel, medical, accident, cancellation, luggage, and activity insurance.
Any insurance stated as included with a Service is subject to the insurer’s conditions, exclusions, limits, claim procedures, and eligibility requirements.
The existence of operator-provided insurance does not guarantee that every incident, person, nationality, medical expense, personal item, or activity is covered.
mytour does not act as the insurer unless expressly stated.
45. Circumstances Beyond Reasonable Control
Neither mytour nor a Service Provider will be responsible for failure or delay caused by circumstances beyond reasonable control, including:
· Severe weather;
· Natural disasters;
· Floods;
· Earthquakes;
· Fires;
· Epidemics or public-health emergencies;
· War, terrorism, or civil unrest;
· Government actions;
· Border or airport closures;
· Travel restrictions;
· National park closures;
· Strikes;
· Utility or telecommunications failures;
· Major transport disruption; or
· Other unavoidable and extraordinary events.
Where such circumstances affect a booking, mytour may assist with rescheduling, alternatives, credit, or refunds in accordance with the applicable booking conditions and law.
mytour is not responsible for unrelated costs such as flights, hotels, visas, meals, or onward travel unless expressly agreed or required by law.
46. Third-Party Websites and Services
The Platform may contain links to external websites, maps, social-media platforms, payment providers, messaging services, or other third-party services.
mytour does not control third-party services and is not responsible for their availability, security, accuracy, content, privacy practices, or terms.
A link does not necessarily mean that mytour endorses the third party.
Customers use external services subject to the third party’s own terms and policies.
47. Dealings Outside the Platform
mytour is not responsible for separate transactions, upgrades, purchases, extensions, or agreements made directly between a customer and a Service Provider outside the confirmed mytour booking.
Payments made directly to a Service Provider must be supported by the Service Provider’s own receipt or documentation.
Where a customer independently changes or expands a booking directly with a Service Provider, mytour may be unable to manage, refund, or resolve that separate arrangement.
48. Limitation of Liability
My Tour Co., Ltd. is responsible for direct loss caused by its breach of contract, negligence, or other legally actionable conduct, subject to applicable law.
To the maximum extent permitted by law, My Tour Co., Ltd. is not liable for:
· Indirect or consequential loss;
· Loss of profit, revenue, business, opportunity, or anticipated savings;
· Loss caused by inaccurate information provided by the customer;
· Loss resulting from a customer’s failure to follow instructions;
· Loss caused solely by an independent Service Provider where My Tour Co., Ltd. is not legally responsible for that conduct;
· Events outside reasonable control; or
· Loss that could not reasonably have been anticipated when the booking was made.
Where legally permitted, the total liability relating to a booking will not exceed the amount actually paid to mytour for the affected Service.
This limitation does not apply where liability cannot legally be limited or excluded, including where applicable in cases involving fraud, wilful misconduct, gross negligence, death, personal injury, or mandatory consumer rights.
49. Responsibility of Independent Service Providers
Independent Service Providers remain responsible for the operation and delivery of Services they perform.
Operational complaints concerning a Service Provider may need to be investigated with that provider.
mytour may assist by communicating with the Service Provider, collecting relevant information, coordinating an operational response, or processing an approved refund.
Such assistance does not automatically mean that My Tour Co., Ltd. accepts legal responsibility for every act or omission of the Service Provider.
Nothing in this section limits any responsibility My Tour Co., Ltd. has under mandatory law or because of its own representations, acts, or omissions.
50. Customer Indemnity
To the extent permitted by law, a customer may be responsible for reasonable direct loss suffered by My Tour Co., Ltd. as a result of the customer’s:
· Fraud;
· Deliberate misuse of the Platform;
· Unlawful conduct;
· Material breach of these Terms;
· Deliberate damage;
· False payment dispute; or
· Violation of another person’s rights.
This provision does not make a customer responsible for losses caused by My Tour Co., Ltd. or for losses that are remote, unreasonable, or not legally recoverable.
51. Acceptable Use
You must not:
· Use the Platform for an unlawful or fraudulent purpose;
· Attempt unauthorized access to an account, server, database, or system;
· Introduce malware, malicious code, or harmful material;
· Interfere with Platform operation or security;
· Use automated tools to overload or disrupt the Platform;
· Scrape, crawl, harvest, or systematically extract Platform data without permission;
· Circumvent booking limits, access controls, or security measures;
· Make false bookings;
· Impersonate another person;
· Resell Services without authorization; or
· Use Platform information to harass customers, employees, or Service Providers.
mytour may restrict access, cancel affected bookings, preserve evidence, and report suspected unlawful conduct where appropriate.
52. Suspension and Termination
mytour may suspend or terminate a customer’s access to the Platform where reasonably necessary because of:
· Fraud or attempted fraud;
· Security concerns;
· Illegal activity;
· Repeated abusive conduct;
· Serious or repeated breach of these Terms;
· Threats to customers, staff, or Service Providers;
· Unauthorized commercial use; or
· A legal or regulatory requirement.
Suspension or termination does not automatically cancel confirmed bookings unless the booking is affected by the reason for suspension or cannot lawfully or safely proceed.
53. Privacy and Personal Data
mytour processes personal data in accordance with its Privacy Policy and applicable data-protection law.
Personal data may be shared with relevant Service Providers, payment processors, technology providers, insurers, authorities, and other parties where reasonably necessary to process payments, confirm bookings, provide Services, protect safety, prevent fraud, comply with law, or handle complaints.
Customers who provide personal information about another participant confirm that they are authorized to provide that information and have informed the participant of the relevant processing.
The Privacy Policy forms part of the rules governing use of the Platform.
54. Electronic Communications
You agree that booking confirmations, tickets, vouchers, receipts, notices, amendments, and other communications may be provided electronically.
Electronic communications may be delivered through:
· The Platform;
· Your customer account;
· Email;
· WhatsApp;
· SMS; or
· Another contact method supplied by you.
You are responsible for keeping your contact details current and checking messages relating to your booking.
An electronic record or confirmation may be used as evidence of the booking and related communications, subject to applicable law.
55. Notices to mytour
Formal booking notices, cancellation requests, and complaints should be sent through an official mytour contact channel.
Customers should include:
· Their full name;
· Booking reference;
· Service date;
· Contact information;
· A clear description of the request or issue; and
· Relevant photographs, receipts, messages, or other evidence where available.
mytour may request further information reasonably required to investigate the matter.
56. Complaints and Resolution
mytour may review complaints and request information from the customer, Service Provider, payment provider, or other relevant parties as necessary to investigate the matter.
Customers must provide reasonable cooperation and accurate information.
Where a complaint is justified, a resolution may include:
· An explanation;
· Correction of an error;
· Rescheduling;
· Replacement service;
· Partial refund;
· Full refund;
· Booking credit; or
· Another reasonable remedy.
The appropriate remedy depends on the circumstances, evidence, booking conditions, portion of the Service received, and applicable law.
57. Governing Law
These Terms and any booking made through My Tour Co., Ltd. are governed by the laws of Thailand.
Nothing in these Terms removes any mandatory consumer protection available to a customer under applicable law.
58. Dispute Resolution and Jurisdiction
Customers should first contact mytour and allow a reasonable opportunity for the matter to be investigated and resolved.
If a dispute cannot be resolved amicably, it may be submitted to a competent court or authority in Thailand in accordance with applicable law.
Where mandatory consumer law permits a customer to bring a claim before another competent authority or court, nothing in these Terms prevents the customer from exercising that right.
59. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be interpreted or limited to the minimum extent necessary.
If it cannot be validly interpreted or limited, it will be severed.
The remaining provisions will continue in effect.
60. No Waiver
If mytour does not immediately enforce a right under these Terms, that does not mean that right has been waived.
A waiver is effective only for the specific matter for which it is given.
61. Assignment
Customers may not transfer a booking or their rights under these Terms where the Service is non-transferable or where the transfer would violate ticket, identification, safety, pricing, or Service Provider requirements.
My Tour Co., Ltd. may transfer or assign its rights and obligations as part of a lawful corporate reorganization or business transfer, provided that the customer’s material rights are not reduced.
62. Entire Agreement
These Terms, the Service-specific conditions, the booking confirmation, the checkout information, and any expressly incorporated policy form the agreement relating to the booking.
They replace prior discussions or representations concerning that booking, except where a representation was expressly confirmed in writing or cannot legally be excluded.
63. Language
These Terms may be made available in English, Arabic, Thai, or other languages.
The translations are provided for customer convenience.
To the extent permitted by law, the English version will prevail where there is a material conflict or inconsistency between the English version and a translated version.
This language clause does not limit any mandatory requirement under Thai law or prevent a court or authority from considering the Thai-language legal meaning where required.
