General Terms and Conditions for the Use of the mytour Platform<\/p>\n
Agreement
The platform mytour.sa or \u201cMytour\u201d (collectively referred to as \u201cMytour\u201d) is operated by Bousselah Al-Rahlat Company, a Limited Liability Company registered in Riyadh, Kingdom of Saudi Arabia, Commercial Registration No. 1009097321. By accessing the platform or using any of the services provided through it (the \u201cServices\u201d), you agree to be bound by these Terms and Conditions. The terms \u201cyou\u201d or \u201ccustomer\u201d refer to any person who accesses the platform or purchases services through it. If you do not agree to these Terms, you must refrain from using the platform.<\/p>\n<\/li>\n
Platform Status
Mytour operates exclusively as a technical online intermediary platform for listing and facilitating services provided by independent operators. Mytour is not considered a direct provider of tourism services, transportation services, or activities displayed on the platform. The contractual relationship regarding the execution of the service is established directly between the customer and the operator. The operator bears full responsibility for the execution of the service and compliance with applicable laws in the country where the activity takes place.<\/p>\n<\/li>\n
Modification of Terms
Mytour reserves the right to modify these Terms at any time. Continued use of the platform after the publication of any modifications constitutes acceptance of the updated Terms.<\/p>\n<\/li>\n
Access to Services
Services may be provided directly by Mytour or through independent operators. Mytour does not guarantee uninterrupted or continuous access to the platform. Mytour reserves the right to modify, suspend, or terminate services at any time without prior notice.<\/p>\n<\/li>\n
Images and Descriptions
Images, videos, and descriptions displayed on the platform are for illustrative purposes only. The actual experience, activity details, vehicles, locations, or arrangements may vary depending on what is provided by the operator. Minor differences do not constitute a contractual breach as long as the core service agreed upon is delivered.<\/p>\n<\/li>\n
Intellectual Property
All content displayed on the platform, including text, images, designs, logos, visual identity, the Mytour name, trademarks, and related domain names are owned by or licensed to Bousselah Al-Rahlat Tourism Organization Company and are protected under applicable intellectual property and trademark laws. No part of the platform, its logo, trademarks, or content may be copied, reproduced, distributed, modified, or exploited without prior written permission.<\/p>\n<\/li>\n
User Accounts and Eligibility
By using the platform, you confirm that you are at least 18 years old or are using the platform under the supervision of a legal guardian. You are responsible for the accuracy of the information you provide and for maintaining the confidentiality of your account credentials. Mytour may suspend or terminate any account in cases of fraud, misuse, or violation of these Terms.<\/p>\n<\/li>\n
Reviews and User Content
By submitting a review or any content on the platform, you grant Mytour a perpetual and irrevocable license to use such content for operational and promotional purposes. You are solely responsible for the accuracy, legality, and authenticity of the content you publish. Mytour reserves the right to remove, edit, or moderate any content without prior notice.<\/p>\n<\/li>\n
Booking Confirmation and Tickets
Bookings are usually confirmed instantly, although some services may require additional confirmation time. Once a booking is confirmed, the booking confirmation, ticket, or voucher may be made available through the customer account on the platform or delivered via email or other notification channels used by the platform. The customer agrees to receive booking notifications, confirmations, and updates via the contact information provided during the booking process.<\/p>\n<\/li>\n
Fees and Payments
All payments are collected in Saudi Riyals (SAR). Banks, payment processors, or financial institutions may apply additional conversion or transaction fees for which Mytour is not responsible. Mytour reserves the right to modify pricing, service fees, or payment structures at any time.<\/p>\n<\/li>\n
Coupons, Promotional Codes, and Discounts
Mytour may offer coupons, promotional codes, vouchers, referral discounts, or other promotional incentives from time to time. These promotions are provided at the sole discretion of Mytour and may be subject to specific conditions including expiration dates, minimum purchase values, usage limitations, and eligible services. Coupons and promotional codes may be used only once unless otherwise stated and may not be combined with other promotions unless explicitly permitted. Coupons have no cash value and cannot be redeemed for cash, transferred, sold, or exchanged. If a booking made using a coupon or promotional code is cancelled, the coupon may be considered used and may not be reinstated unless otherwise determined by Mytour. Mytour reserves the right to cancel, suspend, or invalidate any coupon or promotional code if misuse, abuse, fraud, or violation of promotional terms is suspected, including but not limited to creating multiple accounts to obtain discounts or attempting to manipulate promotional systems. Mytour also reserves the right to modify, suspend, or terminate any promotional program at any time without prior notice.<\/p>\n<\/li>\n
Fraud Prevention
Mytour reserves the right to suspend accounts, cancel bookings, or temporarily hold funds if fraudulent activity, unauthorized payment use, abuse of promotions, or chargeback attempts are suspected. Mytour may take legal action to recover any associated losses, damages, or operational costs.<\/p>\n<\/li>\n
Cancellation and Refund Policy
Cancellation and refund policies are subject to the specific terms of the tour or service as described on the activity page. In general, refunds are not provided for no-shows or cancellations outside the allowed cancellation window. If the operator fails to deliver the service, any refund will be subject exclusively to the operator\u2019s policy. Mytour is not obligated to provide compensation from its own funds and acts only as an administrative coordinator. In all cases, any refund or reimbursement shall not exceed the amount actually paid for the booking in dispute.<\/p>\n<\/li>\n
Claim Submission Period
Any complaint or claim related to a service must be submitted within a maximum of three (3) calendar days from the date of the activity or service. Failure to submit a claim within this period constitutes a waiver of any right to submit such claims later.<\/p>\n<\/li>\n
Pricing Errors
In the event of technical, programming, or human errors in displayed pricing or service information, Mytour reserves the right to cancel the booking and refund the full amount paid. Such cancellation shall not be considered a contractual breach and does not entitle the customer to any additional compensation.<\/p>\n<\/li>\n
Rescheduling
Operators may change the timing, sequence, or arrangement of services due to operational, logistical, weather, or safety reasons. Any alternative arrangement provided by the operator shall be considered an acceptable and valid solution.<\/p>\n<\/li>\n
Acknowledgment of Risk
Customers acknowledge that certain tourism, marine, recreational, or adventure activities inherently involve physical risks. Participation in such activities is entirely at the customer\u2019s own responsibility. Customers must ensure they are physically capable of participating in the activity and must follow all safety instructions provided by the operator or activity staff. The operator reserves the right to refuse participation to anyone who fails to comply with safety requirements without entitlement to a refund.<\/p>\n<\/li>\n
Transportation and Delays
Mytour is not responsible for delays caused by traffic conditions, weather conditions, flight delays, airport procedures, or other circumstances beyond reasonable control. Customers are responsible for providing accurate travel information and notifying the operator of any changes.<\/p>\n<\/li>\n
Punctual Attendance
Customers must arrive at the designated meeting point or pickup location at the time specified in the booking confirmation. Failure to arrive on time resulting in missing the tour, transportation, or activity will be considered a no-show and will not be eligible for a refund or compensation.<\/p>\n<\/li>\n
Accuracy of Information
Customers are fully responsible for providing accurate and complete information during booking including contact information, flight details, accommodation location, participant information, and activity preferences. Mytour shall not be responsible for service disruptions caused by incorrect or incomplete information provided by the customer.<\/p>\n<\/li>\n
Personal Belongings
Customers are responsible for safeguarding their personal belongings during activities, transportation, or tours. Neither Mytour nor the operator shall be responsible for lost, stolen, or damaged personal property during the service.<\/p>\n<\/li>\n
Photography During Activities or Services
Operators, guides, photographers, or service staff may take photos or videos during activities or services for operational documentation or promotional purposes. By participating in the activity or service, customers acknowledge and agree that their image may appear in such materials and may be used by the operator or the platform in marketing, promotional materials, websites, or social media without financial compensation. Customers who do not wish to appear in such materials must inform the operator before the activity begins.<\/p>\n<\/li>\n
Activity Cancellation by Operator
Operators may cancel or modify activities due to weather conditions, safety requirements, operational issues, insufficient participant numbers, or regulatory requirements. In such cases, the activity may be rescheduled or cancelled in accordance with the operator\u2019s policies.<\/p>\n<\/li>\n
Force Majeure
Mytour shall not be responsible for cancellations, interruptions, or delays resulting from events beyond reasonable control including severe weather conditions, government actions, natural disasters, airport closures, travel restrictions, or other unforeseen circumstances.<\/p>\n<\/li>\n
Limitation of Liability
Under all circumstances, the total liability of Bousselah Al-Rahlat Tourism Organization Company shall not exceed the amount actually paid for the booking in dispute, and this amount shall represent the maximum possible compensation. Mytour shall not be liable for indirect damages, consequential damages, punitive damages, loss of profits, loss of opportunity, or moral damages.<\/p>\n<\/li>\n
Third-Party Dealings
Any interaction, transaction, or agreement between the customer and an operator or any other third party is solely at the customer\u2019s own risk. Mytour shall not be responsible for disputes arising between customers and operators.<\/p>\n<\/li>\n
Disputes Relating to Operators
If a dispute arises from the execution of services by an operator outside the Kingdom of Saudi Arabia, legal responsibility lies with the relevant operator according to the laws of the country where the activity takes place. Customers acknowledge that claims related to the execution of the activity must be directed to the operator before the competent courts in the country where the service is performed. If the dispute relates to an error made directly by Mytour, the competent courts in Riyadh, Kingdom of Saudi Arabia shall have exclusive jurisdiction.<\/p>\n<\/li>\n
Passports and Visas
Customers are responsible for ensuring they meet all entry requirements including visas, passports, travel documents, permits, and insurance before travel.<\/p>\n<\/li>\n
Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the Kingdom of Saudi Arabia.<\/p>\n<\/li>\n
Severability
If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall remain valid and enforceable.<\/p>\n<\/li>\n
Acceptable Use of the Platform
Users agree not to use the platform for unlawful purposes or attempt to access, disrupt, interfere with, or damage the platform\u2019s systems, databases, or infrastructure. The use of automated tools, scraping software, bots, or unauthorized extraction of platform data is strictly prohibited.<\/p>\n<\/li>\n
Language
These Terms are written in Arabic. In the event of any conflict between the Arabic version and any translated version, the Arabic version shall prevail.<\/p>\n<\/li>\n
